This access agreement constitutes a legally binding agreement by and between Pacific Reproductive Services, Inc. and you concerning your access and use of either Donor Interview Videos or Adult Donor Photographs made available through the www.pacrepro.com website.

By accepting this agreement, you represent and warrant that you have read and understood, and agree to be bound by, this agreement.

1. Pacific provides Donor Video Interviews and Adult Donor Photographs for the sole purpose of assisting you in selecting a donor. You agree that you will make only personal, non-commercial use of this information for that purpose. All other uses are prohibited.

2. You agree that you will not copy, record, save, photograph, distribute, broadcast, transmit or publish Donor Video Interviews or Adult Donor Photographs, either in whole or in part, in any means of distribution now known or created in the future. YOU SHALL BE SOLELY RESPONSIBLE FOR ANY VIOLATIONS OF ANY LAWS AND FOR ANY INFRINGEMENT OF THIRD-PARTY RIGHTS CAUSED BY YOUR BREACH OF THIS SECTION. YOU MAY BE HELD LIABLE FOR ANY LOSSES INCURRED BY PACIFIC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS, AGENTS, AND REPRESENTATIVES DUE TO YOUR BREACH OF THIS SECTION.

3. You agree to make reasonable efforts to protect the content of Donor Video Interviews and Adult Donor Photographs and the privacy of donors by, without limitation, restricting access to this information in such a way that prevents third-party copying, distributing, broadcasting, transmitting, displaying, reproducing or publishing of this information, either in whole or in part, in any means of distribution, publication or exhibition now known or created in the future. You agree not to give your account user name or password to anyone, and to promptly notify Pacific if your account is accessed or used without your permission.
